1. Base Legal
Estos Términos se redactan en cumplimiento de:
- Ley General de Turismo N° 29408
- D.S. 004-2016-MINCETUR – Reglamento de Agencias de Viajes y Turismo
- Reglamento de Prestación de Servicios Turísticos de Aventura y Parques Naturales
- Código Civil del Perú
- Normativa vigente en materia de consumo y protección al turista
2. Booking and Payment Conditions
2.1 A booking is confirmed only after the required deposit has been paid.
2.2 Full payment must be completed before the start date of the service.
2.3 The company provides full detailed information about the itinerary, inclusions, exclusions and risks prior to purchase, in compliance with Peruvian regulations for tourist services.
3. Price, Inclusions and Exclusions
3.1 All prices include only the services listed in the official itinerary.
3.2 Services not indicated as included are considered exclusions and must be paid separately (extra meals, personal expenses, additional equipment, accommodations, etc.).
4. Cancellations and Refunds
4.1 All cancellations must be requested in writing.
4.2 Unless stated otherwise in the specific program:
- 30+ days before departure: 70% refunded
- 15–30 days before departure: 50% refunded
- Less than 15 days before departure: non-refundable
4.3 No refunds apply once the tour has started.
4.4 No-shows are non-refundable.
5. Tour Modifications and Operational Safety
5.1 Ausangate Trek S.A.C. may modify itineraries for operational, safety, weather or authority reasons.
5.2 If the modification is due to force majeure or government restrictions (blockades, community closures, extreme weather), the following applies:
- Reschedule without penalty
- Change of tour of equal value
- Travel credit valid for 12 months
No immediate cash refund applies.
6. Mandatory Travel Insurance
In accordance with Peruvian regulation for adventure tourism:
All participants must have travel insurance including:
- Medical attention
- Evacuation at high altitude
- Accident and injury
- Repatriation
The company does not sell insurance but may require proof of coverage.
7. High-Altitude Risk Disclosure
The client acknowledges the inherent risks of high-altitude trekking:
- Sudden weather changes
- Altitude sickness
- Operations in remote areas with limited medical access
Participation implies acceptance of these risks.
8. Limitation of Liability
Ausangate Trek S.A.C. is responsible for the safety and organization of the service, but shall not be liable for:
- Force majeure
- Accidents caused by negligence or disobedience
- Loss of personal belongings
- Delays or failures caused by third-party services
9. Client Responsibilities
The client agrees to:
- Follow guide instructions
- Provide accurate medical information
- Use equipment properly
- Carry valid travel documents
Failure to comply may result in removal from the activity for safety reasons, without refund.
10. Responsible Operation
Ausangate Trek S.A.C. guarantees:
- Certified guides and staff
- Communication and emergency equipment
- Compliance with safety protocols required by MINCETUR
- Respect to local communities and natural areas
11. Claims and Customer Protection
The company complies with Peruvian consumer protection rules and maintains:
Libro de Reclamaciones físico y/o virtual, as required by law.
12. Governing Law
These Terms are governed by the laws of Peru. Any dispute shall be resolved before Peruvian authorities.
13. Acceptance of Terms
By booking any service with Ausangate Trek S.A.C., the client accepts these Terms of Sale and Insurance.
